Career Overview

For nearly five decades the focus of Eliot’s life has been as an advocate for the rule of law as both a guide and a tool for how to live and how to succeed in business. Since my admission to the New York Bar in 1978, my professional journey has been anything but one-dimensional. I began in public service as a federal prosecutor in the Southern District of New York, where the stakes were high and the lessons about justice, integrity, and preparation were enduring. From there, I transitioned into private practice, immersing myself in corporate and securities law, and later taking on the challenges of insurance defense litigation.

In those early years, I stood in courtrooms and boardrooms alike—trying cases ranging from complex civil racketeering to intricate medical malpractice disputes, and negotiating deals that would shape the futures of the businesses I represented. Over the decades, my practice expanded across borders and cultures, with more than 30 years devoted to fostering U.S.–China trade and investment. That work included four years living in Shanghai, serving as foreign legal counsel within a Chinese law firm, where I experienced firsthand the legal, commercial, and cultural dynamics that define cross-border transactions.

My career has also been marked by service as both acting in-house counsel and outside counsel to public and private companies, as well as to non-profits whose missions extended beyond profit into public good. Whether working in litigation, arbitration, negotiation, or governance, my aim has always been the same: to combine legal precision with strategic foresight, helping clients—whether entrepreneurs, established corporations, or non-profit organizations—navigate complexity with clarity and confidence.

My Journey

The first 10 years of private law practice involved working in the trenches of corporate law and litigation and in the venture capital field, helping emerging enterprises develop, structure, fund, staff and build their businesses.  These experiences exposed me to all aspects of business and law across a wide variety of fields including:  manufacturing, technology, aviation, shipping, intellectual property, contract negotiation and enforcement, real estate, hotels and hospitality, business financing, products liability, medical malpractice, insurance and civil dispute resolution.

The next 30+ years focused on applying what we knew about guiding young companies and developed ones in helping them to navigate issues of cross-border, cross-cultural business and law between the U.S. and China.  Central to that was explaining and promoting the advantages of the rule of law as it then existed in the United States, and as it developed in China and in international business involving the U.S. and China.

I also promoted the rule of law more broadly as President of the U.S.-China Chamber of Commerce, a bi-National non-profit, NGO promoting US-China trade and investment.  In that capacity I met and spoke with many Chinese businesses, government officials and trade groups, led trade missions of American companies to China, and taught the complexities and opportunities of cross-border transactions to U.S. and Chinese lawyers and businessmen and women.

Our clients have been the most important aspect of our practice as they entrusted us with their challenges, their troubles and their aspirations. They believed that our team of talented professionals could and would help them navigate the trials of the moment and aid them in the development, expansion and security of their businesses in order to achieve their goals. To them, and to our team and colleagues over the years, I owe a tremendous debt of gratitude.  Thank you. Preserving the Rule of Law

Eliot’s career has been an honor and a privilege beyond anything he imagined in his youth. Central to whatever success Eliot has had in life and career was his parents’ belief in education and world travel.

Also central was having been born in the United States, attending high school at The Choate School and being inspired by President John F. Kennedy, who also attended Choate. President Kennedy in his inaugural address in 1961 encouraged all of us to "Ask not what your country can do for you—ask what you can do for your country."

Now, towards the end of Eliot’s career (in 2025) a new challenge has arisen: doing whatever he can to preserve the Rule of Law which is under assault in the United States, as it has never been before. It is more important now than ever for each of us to work to protect and defend the Constitution of the United States, the institutions of our democratic government, and our many friendships and alliances, against all enemies, foreign and domestic. 

For American democracy to succeed, for any democracy to succeed, no person, no leader and no judge can be above the law and above the essential moral and ethical values and responsibilities that have guided the growth and development of Western democracies.

Even China’s paramount leader Deng Xiao Ping, in discussing China’s need to “Open to the Outside World” in 1978, had learned a few lessons from the West, among them:  

  • “Get Truth from Facts.”

  • “It does not matter if the cat is white or black
    as long as it catches mice.”

  • "For China to succeed it has to evolve
    from a society based on the rule of men
    to a society based on the rule of law."

Now it is time for the United States to learn from China, what China learned from the US.
